•  File an Adoption Petition in Circuit or Chancery Court, if the natural parents still have rights this petition must include a request to terminate parental rights.*
•  Have a complete home study and background investigation report filed with the court from an approved and licensed agency.  This requirement may sometimes be waived by the court in family adoptions. Speak to an attorney about this.
•  Attend a hearing to terminate parental rights.
•  Attend a final hearing on the adoption.
•  If the child is 14 or older the child must consent in writing to the adoption.
•  * A parent will be given 30 days to answer the petition, and an opportunity to defend himself or herself in court.
